PRIMARY PRODUCER SOLE USE RULE NOW IN FORCE

A Ministerial Exemption Order was published on 1 July 2022 in relation to the requirement that applicants for a primary producer concession prove that at least 50% of their income is from primary production.

Under that Order, the period for which primary producers would not be required to provide evidence that 50% of their income is derived from primary producer operations has been extended from 1 November 2022 until 1 November 2023.

However, all other legislative requirements are in force including the sole use requirement.  This means that you can carry primary produce for another primary producer and still be eligible to claim the concession, as long as you are carrying your own primary produce and/or produced by another primary producer and as long as you are NOT receiving a fee or reward.

UPDATE ON TRANSITION OF FUNCTIONS FROM TFNSW TO NHVR

On 1 August, 310 staff including over 250 Compliance Operations Inspectors transferred from the NSW Government to the NHVR. 

On joining the NHVR, these officers will become Safety and Compliance Officers (SCOs) in NSW and will have the same authority stop heavy vehicles and check the vehicle, operator, and driver compliance with the HVNL and other state-based laws. 

This includes checking for compliance with heavy vehicle driver licensing, registration, and road rules.

TFNSW will continue to licence heavy vehicle drivers in NSW, register heavy vehicles, monitor road rule-related camera detected offences including speeding and red light offences.  

Service NSW will continue to accept HVIS bookings for inspection of vehicles and sell National Written Work Diaries.

NSW is the fifth state or territory – after South Australia, Tasmania, ACT and Victoria – where the NHVR will be directly delivering heavy vehicle regulatory services.  Queensland is scheduled to transition in 2024.

 

FIRST PLACE-BASED TRANSPORT PLAN DEVELOPED FOR WAGGA 

The Wagga Wagga Transport Plan is the first place-based transport plan developed by Transport for NSW for a regional city in NSW. As a supporting plan of Future Transport, the Plan provides a blueprint for transforming the way people and goods will travel within, to and through Wagga Wagga over the next 20 years.

The Plan outlines the vision for the 4,424-hectare Wagga Wagga Special Activation Precinct to the north of the regional city which will deliver between 3,400 and 6,050 jobs by 2040 and will establish Wagga Wagga as the key intermodal freight hub for the Riverina-Murray region.  Duplication of the Gobbagombalin bridge as well as investigating changing travel demands along the Sturt Highway corridor are included in the Plan.

INTELLIGENT ACCESS CONDITIONS CERTIFICATE OF ENROLMENT

To support the transition of Intelligent Access Program (IAP) services from NSW to the NHVR, Transport Certification Australia are currently re-issuing all Intelligent Access Conditions (IAC) for the NHVR.  This will result in you receiving new IAP Certificates issued by the NHVR.    However, these certificates are being provided for your records only and do not replace your current TFNSW Certificate of Enrolment.

In due course you will receive a new Certificate of Enrolment issued by the NHVR that will not have an expiry date and will not need to be renewed.  This is because Authorised Officers will have systems to validate your NHVR Certificate of Enrolment currency.
